Use of the website and/or the making of any purchase implies acceptance of these General Terms and Conditions of Sale and Contracting (hereinafter, the ‘Conditions’).
1. Purpose and scope
These Conditions govern the online sale of products and/or services offered via the website www.picartpetcare.com as well as the purchasing process, delivery, returns, warranties and after-sales service.
Where specific terms and conditions are published in product descriptions or promotional campaigns, these shall take precedence over the present terms and conditions in respect of the matters specifically covered.
2. Purchasing process and formation of the contract
2.1. Order. To place an order, the customer must follow the online checkout process and select a payment method at the end of the process.
2.2. Confirmations. The mere acknowledgement of receipt of the order (‘Order Confirmation’) does not imply acceptance of the order. The contract is deemed to have been concluded when the seller sends the ‘Shipping Confirmation’ or, where applicable, an express confirmation of acceptance.
2.3. Availability. All orders are subject to availability. In the event of any stock or supply issues, the customer will be notified and a refund will be issued within a maximum of 30 calendar days.
2.4. Customer details. The customer guarantees that the information provided is true and accurate. The customer shall be liable for any delivery errors caused by incorrect details.
3. Price, taxes and payment methods
3.1. Prices. Unless otherwise stated, the prices shown include applicable taxes (VAT) and are quoted in euros. Delivery charges will be shown during the checkout process.
3.2. Blatant errors. If an obvious error is detected in the price, you will be given the option to reconfirm your order at the correct price or to cancel it and receive a refund. There shall be no obligation to supply the product at a price that is clearly incorrect.
3.3. Payment methods. We accept [credit/debit cards, Bizum]. Cards are subject to verification by the issuing bank; if the payment is not authorised, the contract cannot be finalised.
4. Shipping, delivery and risk
4.1. Carriers and delivery coverage. Deliveries are made via MRW and are delivered within Spain. We do not deliver to the Balearic Islands, the Canary Islands, Ceuta or Melilla. Estimated delivery times are 2–3 working days from order confirmation, barring force majeure or issues with the carrier.
4.2. Delivery attempts and collection points. Where the parcel weighs 5 kg or less, if the recipient is not at home, the carrier may deliver the parcel to a collection point and hold it there for the period specified by the carrier. Once this period has elapsed, the order will be returned and a refund will be issued for the cost of the product, excluding delivery charges.
4.3. Risk and verification. The risk of loss or damage passes to the customer upon handover to the carrier for shipments sent directly to the customer. The customer must check the condition of the parcel and note any visible damage on the delivery note.
4.4. Limitations. The seller shall not be liable for delays attributable to the carrier or for any damage sustained once the parcel has been handed over to the carrier.
5. Right of withdrawal and returns policy
5.1. Legal withdrawal. The customer has 14 calendar days from receipt to withdraw from the contract without having to provide any justification. To exercise this right, the customer must communicate it clearly through the channels indicated in these Conditions.
5.2. Effects. The seller shall refund any payments received, including standard delivery charges, without undue delay and, in any event, within 30 days of being notified of the withdrawal. The refund may be withheld until the goods have been received or until the customer provides proof of their return.
5.3. Product returns. The customer must return the goods without undue delay and, in any event, within 14 calendar days of notifying us of their decision to withdraw. The customer shall bear the direct costs of returning the goods, unless the seller is at fault.
5.4. Exceptions. The right of withdrawal does not apply, among other cases, to: goods manufactured according to customer specifications; goods sealed for health or hygiene reasons that have been unsealed; goods that are liable to deteriorate or expire quickly; digital content without a physical medium where performance has begun with the customer’s express consent.
5.5. Returns due to a seller’s error. In the event of a faulty product or an error in the delivery, the process will be free of charge to the customer, including return postage and a refund.
6. Warranties and limitation of liability
6.1. Legal guarantee of conformity. For purchases made by consumers, the products are covered by the statutory warranty in accordance with the applicable regulations. In the event of a lack of conformity, the customer may request repair, replacement, a price reduction or cancellation, in accordance with the law.
6.2. Use and risks. Products must be used in accordance with the manufacturer’s instructions. The seller shall not be liable for indirect losses or loss of profit, nor for damages arising from force majeure or events beyond its reasonable control.
6.3. Retention of title. Until full payment has been made, the goods shall remain the property of the seller.
7. Customer service and complaints

8. Alternative dispute resolution and jurisdiction
8.1. ADR/RAL. The seller informs customers that they may refer matters to Alternative Dispute Resolution (ADR) bodies for consumer disputes accredited under Law 7/2017. Up-to-date information and official list: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.
8.2. ODR platform. The previous European Online Dispute Resolution (ODR) platform has been discontinued by the European Commission (no new claims are being accepted since 20 March 2025, and the platform will close permanently on 20 July 2025).
8.3. Jurisdiction and applicable law. These Conditions are governed by Spanish law. For consumers, the courts of the consumer’s place of residence shall have jurisdiction. In B2B contracts, the parties agree to submit to the courts and tribunals of Barcelona, waiving any other jurisdiction to which they might otherwise be entitled.
9. Protection of personal data
The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD). PIENSOS PICART, S.A. is the legal entity responsible for the collection and processing of your personal data in connection with the services it provides.

The seller will act as the data controller and will process the data for the purposes of managing purchases, customer service and marketing communications where there is a legal basis for doing so. In accordance with current legislation, PIENSOS PICART, S.A. collects only the data strictly necessary to provide the services arising from its business activities and other services, procedures and activities required by law.
The customer may exercise their rights of access, rectification, erasure, objection, restriction and data portability. Further information is available in the website’s Privacy Policy.
Personal data will be retained for as long as necessary to fulfil the purpose for which it was collected and in accordance with the legally established retention periods, unless, for logical and obvious reasons, it has lost its usefulness or the legitimate purpose for which it was collected.10. Intellectual and industrial property.
The content, trademarks and distinctive signs on the website belong to the seller or third-party licensors and are protected by applicable legislation. Unauthorised reproduction or use is prohibited.
10. Miscellaneous
10.1. Modifications. The seller may amend these Conditions by publishing the new version on the website. The changes will not affect orders that have already been confirmed.
10.2. Severability. If any provision is held to be invalid, the remaining provisions shall remain in force.
10.3. Communications. Communications will be sent in writing to the email address provided by the customer or, in the case of general notices, by posting on the website.
