ADDITIONAL INFORMATION ABOUT DATA PROTECTION

PIENSOS PICART, S.A. wishes to inform the users of our website www.picartpetcare.com (hereinafter, the “Website”) of this additional information on data protection (hereinafter, “Privacy Policy”), in which we transparently provide all the information on the processing we carry out with your personal data, the purposes for which we process them and the rights you can exercise.

  1. WHO IS RESPONSIBLE FOR PROCESSING YOUR DATA?

The company Responsible for the Processing is PIENSOS PICART, S.A. (hereinafter, “PICART”) incorporated under Spanish law, holder of Tax Identification Code A-08720245 with registered office at Av. de Sant Nonet, 2, 08458 Sant Pere de Vilamajor (Barcelona) and registered in the Commercial Register of Barcelona, Volume 5143, Sheet 66, Page 62521.

  1. WHAT ARE PERSONAL DATA AND WHAT DOES IT MEAN TO PROCESS THEM?

Personal data are pieces of information that identify or can identify an individual. For example, the data that can directly identify a person are their name and surname, while their ID number can also identify him/her. Personal data include information such as mobile phone number, email address, date of birth and gender among others. This may also include numerical identifiers such as your computer’s IP address, as well as information obtained through cookies.

On the other hand, personal data processing is any operation or set of operations that we carry out on your personal data, such as the collection, recording, storage, use and communication of your data.

  1. WHAT DATA DO WE COLLECT?

In order to properly perform the data processing described in this Privacy Policy, we need to collect certain information about you. To this end, we collect the information and data that you provide us through the interaction channels and your communication with PICART. The data we may collect about you through these channels is as follows:

  • Name and surname;
  • E-mail address;
  • Information about your use and browsing of the Website (web page from which you arrived at the Website, layers of the Website visited, processes started and abandoned, IP address, type of device from which you access the Website, time spent on the Website, etc.).
  • Ratings and opinions on news and/or publications.
  • Any information that you can provide when contacting us by any means or channel.
  1. THROUGH WHICH CHANNELS DO WE COLLECT YOUR PERSONAL DATA?

At PICART we only capture and process information that you provide us in the following ways:

  1. Voluntary participation in any of our promotional activities (such as sweepstakes, contests, etc.);
  2. Interaction with PICART when using our contact or customer service;
  3. The form used to post comments and opinions on our Web Site;
  4. The form used to share information about your pet;
  5. Subscription to our newsletter; and
  6. Interaction with the Website and with PICART on social networks.

 

  1. WHAT RIGHTS CAN YOU EXERCISE?

You have the right to know if PICART is processing your personal data and, if so, to know what data it is processing.

  1. Right of rectification

You have the right to change any inaccurate or incomplete information about yourself. To do so, you must indicate which data you wish to modify and provide appropriate proof.

 

  1. Right to object

In the cases provided for by law, you can object at any time, for reasons relating to your particular situation, to our processing of your data. In our case, you can object to all our processing, except for the maintenance of suppression lists, as it is a legal obligation of PICART. Regarding the processing of Management of user participation in promotional activities and management of the relationship with users, remember that your opposition to such treatment will make it impossible for PICART to provide you the requested service. For all other processing whose legitimate basis is your consent, you can always object to them and / or revoke your consent.

 

  1. Right to erasure

This right allows the cancellation of your personal data. This does not mean that your data will be completely deleted, but that your data will be kept blocked in such a way as to prevent their processing, without prejudice to their being made available to public administrations, judges and courts for the attention of possible liabilities that may have arisen as a result of the processing during the prescription period of the latter.

 

  1. Right to data portability

You have the right to receive and/or transfer to a data controller other than PICART any personal data concerning you that you have provided to us.

 

  1. Right to restrict processing

You have the right to ask us to stop processing your data if (i) you have challenged the accuracy of your data, while PICART verifies its accuracy; or (ii) you have exercised your right to object to the processing of your data, while we verify whether PICART’s legitimate grounds override your legitimate grounds as a data subject. Likewise, this right allows you to ask PICART to keep your personal data when (i) the data processing is unlawful and as a data subject you object to the erasure of your data, requesting instead a limitation of its use; or (ii) PICART no longer needs your personal data for the purposes of the processing, but needs them for the formulation, exercise or defence of claims.

You can exercise your rights by sending us your request to the following e-mail address picart@picart.es or by post by means of a written and signed request, proving your identity in both cases, addressed to: PIENSOS PICART, S.A., Av. de Sant Nonet, 2, 08458 Sant Pere de Vilamajor (Barcelona). We also inform you that, in the event that you consider that PICART has not properly satisfied the exercise of your rights, you may file a complaint with the Spanish Data Protection Agency (AEPD), by contacting their website at http://www.aepd.es.

  1. WHAT PROCESSING DO WE CARRY OUT WITH YOUR DATA AND FOR WHAT PURPOSES?

We want to be transparent with you and inform you about the processing we carry out with your data and the purposes for which we process it. For this reason, we have separated the corresponding information into separate tables.

Each descriptive table for each type of personal data processing contains the following information:

In this column we explain for what purpose we process your personal data.

  • What is the legal basis for the processing of your data?

Data protection law requires that we have a legitimate basis for processing your personal data. In order to process your personal information, we rely on the following legal reasons:

  • Contract execution: In order to enable us to comply with the obligations set out in the legal bases governing participation in our promotional activities and to process your personal data. Thus, your refusal to provide us with those personal data that are necessary to participate in our promotional actions will imply the impossibility of allowing you to participate in them.
  • Legal obligation: PICART is responsible for your data and must therefore comply with a series of obligations imposed by accounting, tax, consumer, data protection, etc. regulations. Therefore, PICART will keep confirmation of those users who have requested the deletion of their data on a deletion list, in compliance with the legal obligation arising from Regulation (EU) 216/679 of the Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
  • Your consent: In the event that PICART wishes to carry out any processing of your data whose legal justification cannot be based on the legal bases explained above, such as by contacting us through our customer service, we will request your prior consent for such processing. In any case, we inform you that in such cases you can always withdraw your consent at any time.
  • For how long will we keep your data?

In this column you can see how long your data will be kept for as a guideline. The amount of time for which we keep your personal data will depend in any case on the treatment that is carried out. You should be aware that certain regulations may require us to retain certain user data for a certain period of time.

  • What are your rights when you provide us with your data?

This column describes the rights that you can exercise over your personal data according to the processing that is carried out on them. You should be aware that depending on the legal basis on which your data is processed, your rights may be limited.

  1. Quality testing with users

·         To provide customer service in order to process and respond to queries, doubts or requests for information sent by users.

·         To manage and publish the comments, opinions and reviews sent by users.

User consent. The personal data of the interested party will be processed by PICART while the existing relationship between PICART and the user is in force or while it is necessary to resolve the query made.

Subsequently, the personal data provided will be retained for the legally stipulated period of limitation of actions that may arise.

Upon reaching the maximum period of conservation of personal data, PICART will anonymise or delete the user’s personal data.

You may exercise the rights described in section 5 of this Privacy Policy, as set out in that section.

 

  1. Sending commercial communications electronically.

 

For what purpose do we process your data? On what legal basis do we process your data? For how long will we keep your data? What are your rights and how can you exercise them?
·         Sending commercial communications electronically for information and advertising purposes.

 

 

Consent of the person concerned. Your personal data will be processed by PICART until you exercise your right to object, right to erasure or withdraw your consent.

Subsequently, the personal data provided will be retained for the legally stipulated period of limitation of actions that may arise.

Once the maximum period of data retention has expired, PICART will anonymise or delete the user’s personal data.

You have the right to object to receiving newsletters at any time by the following means:

–  Revoking your consent at any time by sending an email requesting it to picart@picart.es.

 

–  By following the instructions at the bottom of the body of each electronic communication you receive.

  1. Management of participation in promotional actions

 

For what purpose do we process your data? On what legal basis do we process your data? For how long will we keep your data? What are your rights and how can you exercise them?
·         To manage the correct participation of users in the various promotional activities (sweepstakes, contests, etc.) organised by PICART.

·         To manage, where appropriate, the delivery of prizes to the participants win promotional competitions.

·         To manage any incident, request for information or complaint related to or derived from the promotional actions organised by PICART.

·         To comply with PICART’s legal obligations.

Processing is necessary for:

(i)    the execution of the legal bases voluntarily accepted by customers, subscribers and / or users to participate in the various promotional activities organised by PICART.

(ii)  PICART’s compliance with its legally enforceable obligations, arising, among others, from consumer affairs, data protection, taxation and duties.

Your personal data will be processed by PICART until you exercise your right to object, right to erasure or withdraw your consent.

Subsequently, the personal data provided will be kept duly blocked for the legally stipulated period of prescription of the actions that may arise as a result of the existing relationship between PICART and the participant.

Once the maximum period of data processing has expired, PICART will anonymise or delete the user’s personal data.

  1. Maintaining up-to-date suppression lists to avoid being contacted

 

For what purpose do we process your data? On what legal basis do we process your data? For how long will we keep your data? What are your rights and how can you exercise them?
·         To maintain an erasure list with the confirmation of those users who have requested the erasure of their data or shown their opposition to their processing. Legal obligation: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC obliges us to respect your rights and to keep evidence of our compliance with your request to exercise your right to erasure. We will retain your personal data for the legally required period of time for the filing of any complaint in relation to the effective or deficient response by us to the right to erasure or right to object that you have exercised.

Once the maximum period of data retention has expired, PICART will anonymise or delete the user’s personal data.

The rights described in section 5 of this Privacy Policy are limited because this processing is based on a legal obligation.

 

  

  1. Management of recruitment processes

 

For what purpose do we process your data? On what legal basis do we process your data? For how long will we keep your data? What are your rights and how can you exercise them?
·         To process the job application, participation in the recruitment processes and/or the sending of the CV sent by the applicant/candidate.

·         To send the applicant or candidate information electronically or via telephone about new selection processes, employment opportunities and/or vacancies at PICART.

 

The consent of the applicants and/or candidates.

 

The data provided will be retained until the job is awarded, for XX years from the time they were collected or provided by the applicant or candidate or until the applicant or candidate exercises his/her right to object, right to erasure or until he/she withdraws their consent.

Once the maximum period of data retention has expired, PICART will anonymise or delete the job applicant’s personal data.

  1. Analysis of use, operation and improvement of the Website
For what purpose do we process your data? On what legal basis do we process your data? For how long will we keep your data? What are your rights and how can you exercise them?
·         To recognize the user when he/she returns to the corporate website.

·         To maintain security and protect the corporate website from malicious use.

·         To adapt the website to the type of device used.

·         To adapt the website to the personalisation criteria chosen by the user and remember them.

·         To analyse the most common uses of the website, assess the effectiveness of its layers, detect the dates / times of greatest influx of users and detect navigation patterns.

·         To study possible improvements to the website to optimise the usability experience and implement them.

·         To show the correct web content requested by the user at all times.

User consent We will retain your personal data for as long as each type of cookie requires or until you withdraw your consent or exercise your right to object.

Once the maximum period of data retention has expired, PICART will anonymise or delete the personal data.

You may exercise the rights described in point 5 of this Privacy Policy, as stipulated in the aforementioned section.

You can also parametrise the use of cookies through our cookie management tool or through the Internet browser you use to browse the Website, as explained in our Cookies Policy.

 

  1. TO WHOM DO WE DISCLOSE YOUR PERSONAL DATA?

PICART will not communicate the personal information that you provide to us through the channels described in section four to third parties, unless required by law or on the basis that legitimises the communication, in which case you may communicate the personal data to:

  • Legal Advisors
  • Courts
  • Tax Administration
  • Government and Public Administration Agencies
  • State Security Forces
  • Processors who, in order to provide the necessary services, must access certain information and/or personal data. The data may be communicated to suppliers with access to data with whom the obligations and responsibilities they assume in the processing of the data are formalised, as Data Processors. PICART subscribes the corresponding data processing contracts that include the due guarantees regarding the processing of personal data, confidentiality and cancellation, destruction or return.

We may also disclose your personal information in the following cases:

  • If we, or substantially all of our assets, are acquired by a third party, in which case personal data held by us about our users will be one of the transferred assets. You will be previously informed should this event, or any like it, take place.
  • To protect the safety and rights of our staff, our users and our information systems. This includes exchanging information with law enforcement agencies or courts in cases of detection of fraud, identity theft or any other unlawful use, processing or act.

 

  1. IS YOUR DATA SAFE?

In order to ensure fair and transparent processing of your personal information, we will adopt appropriate procedures which will include the implementation of technical and organisational measures that take into account the possible risk and correct any identified imprint on the personal data processed, so that the risk of any error is minimised, by treating your data fairly and securely.

All the information you provide is stored on secure servers. So, once we have received all your information we will use strict security procedures to try to prevent any unauthorised access. Unfortunately, the transmission or communication of information over the Internet is not completely secure.

Likewise, we will ensure that our service providers also have adequate security standards for the protection of personal data to which they have or may have access, in accordance with the applicable data protection legislation in force at any given time.

  1. CHANGES TO THE PRIVACY POLICY

This Privacy Policy may vary over time due to possible changes in the criteria followed by the Spanish Data Protection Agency at any given time, any legislative modifications that may occur and any jurisprudential pronouncements that may be applicable to this privacy policy. PICART therefore reserves the right to modify this Privacy Policy in order to adapt it to these criteria, as well as jurisprudential or legislative developments.
