PIENSOS PICART, S.A. wishes to inform the users of our website www.picartpetcare.com (hereinafter, the “Website”) of this additional information on data protection (hereinafter, “Privacy Policy”), in which we transparently provide all the information on the processing we carry out with your personal data, the purposes for which we process them and the rights you can exercise.

- WHAT ARE PERSONAL DATA AND WHAT DOES IT MEAN TO PROCESS THEM?
Personal data are pieces of information that identify or can identify an individual. For example, the data that can directly identify a person are their name and surname, while their ID number can also identify him/her. Personal data include information such as mobile phone number, email address, date of birth and gender among others. This may also include numerical identifiers such as your computer’s IP address, as well as information obtained through cookies.
On the other hand, personal data processing is any operation or set of operations that we carry out on your personal data, such as the collection, recording, storage, use and communication of your data.
- WHAT DATA DO WE COLLECT?
In order to properly perform the data processing described in this Privacy Policy, we need to collect certain information about you. To this end, we collect the information and data that you provide us through the interaction channels and your communication with PICART. - WHAT RIGHTS CAN YOU EXERCISE?
- Right of access
You have the right to know if PICART is processing your personal data and, if so, to know what data it is processing.
- Right of rectification
You have the right to change any inaccurate or incomplete information about yourself. To do so, you must indicate which data you wish to modify and provide appropriate proof.
- Right to object
In the cases provided for by law, you can object at any time, for reasons relating to your particular situation, to our processing of your data. In our case, you can object to all our processing, except for the maintenance of suppression lists, as it is a legal obligation of PICART. Regarding the processing of Management of user participation in promotional activities and management of the relationship with users, remember that your opposition to such treatment will make it impossible for PICART to provide you the requested service. For all other processing whose legitimate basis is your consent, you can always object to them and / or revoke your consent.
- Right to erasure
This right allows the cancellation of your personal data. This does not mean that your data will be completely deleted, but that your data will be kept blocked in such a way as to prevent their processing, without prejudice to their being made available to public administrations, judges and courts for the attention of possible liabilities that may have arisen as a result of the processing during the prescription period of the latter.
- Right to data portability
You have the right to receive and/or transfer to a data controller other than PICART any personal data concerning you that you have provided to us.

You have the right to ask us to stop processing your data if (i) you have challenged the accuracy of your data, while PICART verifies its accuracy; or (ii) you have exercised your right to object to the processing of your data, while we verify whether PICART’s legitimate grounds override your legitimate grounds as a data subject. Likewise, this right allows you to ask PICART to keep your personal data when (i) the data processing is unlawful and as a data subject you object to the erasure of your data, requesting instead a limitation of its use; or (ii) PICART no longer needs your personal data for the purposes of the processing, but needs them for the formulation, exercise or defence of claims.

We also inform you that, in the event that you consider that PICART has not properly satisfied the exercise of your rights, you may file a complaint with the Spanish Data Protection Agency (AEPD), by contacting their website at http://www.aepd.es.

We want to be transparent with you and inform you about the processing we carry out with your data and the purposes for which we process it. For this reason, we have separated the corresponding information into separate tables.

- What is the legal basis for the processing of your data?
Data protection law requires that we have a legitimate basis for processing your personal data. In order to process your personal information, we rely on the following legal reasons:
- Contract execution: In order to enable us to comply with the obligations set out in the legal bases governing participation in our promotional activities and to process your personal data. Thus, your refusal to provide us with those personal data that are necessary to participate in our promotional actions will imply the impossibility of allowing you to participate in them.
- Legal obligation: PICART is responsible for your data and must therefore comply with a series of obligations imposed by accounting, tax, consumer, data protection, etc. regulations. Therefore, PICART will keep confirmation of those users who have requested the deletion of their data on a deletion list, in compliance with the legal obligation arising from Regulation (EU) 216/679 of the Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

- TO WHOM DO WE DISCLOSE YOUR PERSONAL DATA?
PICART will not communicate the personal information that you provide to us through the channels described in section four to third parties, unless required by law or on the basis that legitimises the communication, in which case you may communicate the personal data to:
- Legal Advisors
- Courts
- Tax Administration
- Government and Public Administration Agencies
- State Security Forces
- Processors who, in order to provide the necessary services, must access certain information and/or personal data. The data may be communicated to suppliers with access to data with whom the obligations and responsibilities they assume in the processing of the data are formalised, as Data Processors. PICART subscribes the corresponding data processing contracts that include the due guarantees regarding the processing of personal data, confidentiality and cancellation, destruction or return.
We may also disclose your personal information in the following cases:
- If we, or substantially all of our assets, are acquired by a third party, in which case personal data held by us about our users will be one of the transferred assets. You will be previously informed should this event, or any like it, take place.
- To protect the safety and rights of our staff, our users and our information systems. This includes exchanging information with law enforcement agencies or courts in cases of detection of fraud, identity theft or any other unlawful use, processing or act.
- IS YOUR DATA SAFE?
In order to ensure fair and transparent processing of your personal information, we will adopt appropriate procedures which will include the implementation of technical and organisational measures that take into account the possible risk and correct any identified imprint on the personal data processed, so that the risk of any error is minimised, by treating your data fairly and securely.

- CHANGES TO THE PRIVACY POLICY
This Privacy Policy may vary over time due to possible changes in the criteria followed by the Spanish Data Protection Agency at any given time, any legislative modifications that may occur and any jurisprudential pronouncements that may be applicable to this privacy policy. PICART therefore reserves the right to modify this Privacy Policy in order to adapt it to these criteria, as well as jurisprudential or legislative developments.
